This Messaging & Acceptable Use Policy (“Messaging Policy”) governs your use of Wonderly’s messaging, AI calling, SMS, MMS, and telecommunications features (“Messaging Services”).
1. Consent & Opt-In Requirements
You are solely responsible for ensuring that you have obtained all legally required prior express consent before initiating any call, SMS, MMS, AI-generated voice call, or automated communication using the Messaging Services.
You must:
- Obtain proper written or digital consent where required by law
- Maintain records of such consent
- Honor all opt-out, unsubscribe, stop, and do-not-call requests immediately
- Maintain internal suppression lists
Wonderly does not obtain consent on your behalf.
2. Prohibited Uses
You may not use Messaging Services for:
- Spam or unsolicited communications
- Purchased, scraped, or third-party lead lists without documented consent
- Deceptive, misleading, or fraudulent content
- Illegal goods or services
- SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco) unless explicitly permitted under carrier rules
- Phishing or impersonation
- Harassment or abusive communications
- Political messaging unless properly registered and compliant with carrier requirements
3. Content Responsibility
You are solely responsible for:
- Call scripts
- AI-generated voice content
- SMS templates
- Message copy
- Landing pages and linked websites
Wonderly does not review or approve message content.
4. Carrier & Platform Compliance
You must comply with:
- All U.S. federal and state telemarketing laws
- TCPA
- CAN-SPAM
- CTIA guidelines
- Carrier rules
- 10DLC requirements
- International telecom laws if applicable
Wonderly may suspend Messaging Services immediately if traffic violates carrier rules.
5. Monitoring & Suspension
Wonderly reserves the right to:
- Monitor messaging traffic patterns
- Suspend accounts generating high complaint rates
- Block traffic flagged by carriers
- Terminate Messaging Services without notice for violations
6. Indemnification
You agree to indemnify and hold harmless Wonderly from any claims, fines, penalties, regulatory investigations, or carrier actions arising from your use of Messaging Services.
